A Study On The Perfection Of The Lawyer Management System In Zhuanghe City

Since the reform and opening up,the lawyer industry has developed vigorously and has become an important force in the construction of the rule of law in our country.The lawyer management system of our country is unique,and in the long practice,it forms the management mode which combines the supervision of the judicial administration and the internal autonomy of the lawyer industry.With the progress of the socialist rule of law,the disadvantages of the existing lawyer management system are also emerging.On the one hand,under the background of administrative reform,the administration of the basic judicial administration tends to have two tendencies in the management of the lawyer industry.One is full regulation and the other is full decentralization.The simple management mode that binds administrative management and industry autonomy cannot meet the demands of industry development.It is necessary to focus on the reintegration of management resources,and explore scientific and effective legal management system from the aspects of institution setting,target positioning,jurisdiction division and legal relationship.On the other hand,most of the research objects of the existing lawyer management system are located in large cities with developed economy,while the practice of lawyers in China is in the grassroots.As a typical prefecture-level city in northern China,studying the management and rule of law practice to primary lawyers of Zhuanghe judicial administration,exploring the relationship of judicial administrative organs and the lawyers association,and perfecting the existing grass-roots lawyer management system has important practical significance and theoretical value.Researching on the improvement of the lawyer management system of Zhuanghe,this paper is divided into five parts:Part I,introduction.The first part explains the research background and research significance of this article,describes the research objectives and methods,and outlines the existing research results at home and abroad.Part II,the present situation analysis of the management system of the lawyers in Zhuanghe.The second part is aimed at the development characteristics of the less total number of lawyers in Zhuanghe,and the development course and basic status of the lawyer management system in Zhuanghe are revealed by the method of on-site interview.The paper sums up the practice of the judicial administration of Zhuanghe and the lawyers association of Zhuanghe on the management of lawyers,and explains the relationship between them.Part III,the problem and cause analysis of the lawyer management system in Zhuanghe.Firstly,we started with the question of the management system of Zhuanghe.The prominent manifestation is that the judicial administrative organ is not in place to regulate the illegal behavior of lawyers.The judicial administrative organ is meticulous in the daily management of lawyers.The excessive intervention of the judiciary has made the lawyers’ association lack of independence.Then,the root of the problem is that the reform of the management system of the lawyer becomes a mere formality,the jurisdiction of the judicial administration and the lawyers association is not clear,and the characteristics of the lawyer management system in Zhuanghe are ignored.Part IV,we propose the improvement suggestions of Zhuanghe lawyer management system.The improvement of zhuanghe lawyer management system is based on the administrative institution reform and innovation under the background of social governance.New government theory and cooperative governance theory is the management system of perfect theory basis.On the basis of drawing lessons from the lawyer management advanced experience of Dongying of Shandong and Qingshui county of Gansu,this paper puts forward the specific and perfect proposal to clarify the function orientation of the judicial administration in Zhuanghe,divide the administrative authority of the judicial administrative organs and lawyers associations of Zhuanghe,strengthen the supervision and guidance of the judicial administrative organs of Zhuanghe.Part V,we get in conclusion.This paper studies the basic structure and perfect suggestion of the lawyer management system in Zhuanghe city to ensure the healthy development of lawyers’ practice rights and the profession of lawyers,and contribute to social development.In the future,I will continue to research and analysis on the management system of lawyers,especially strengthening the analysis of the case,to provide further theoretical thinking for improving our lawyer management system.
