At present, the crime of causing traffic casualties in our country is rising year by year. In order to meet the needs of fighting against such crimes, our criminal legislation, including judicial interpretation, has experienced a process of development and is becoming perfect. However, in criminal academic circles and judicial practice, there are still some issues about the crime of causing traffic casualties warrant approach, not having reached common understanding. Among these issues, some were being disputed but recently have been clearly defined by judicial interpretation; some were not ruled before but have drawn great contention in theoretical area and judicial practice with the enforcement of new legislation and judicial interpretation. In this article, in the light of Article 133 of Criminal Law and some newly passed judicial interpretation, the author starts with the constitution of the crime of causing traffic casualties and makes a thorough research on the question of the characterization of causing traffic casualties with driving non-motor-driven vehicles or without public control rules, the rationality of judicial interpretation about the joint crime of causing traffic casualties and the moral damage of the crime of causing traffic casualties, in the hope of making some benefits to the legislation and judicial interpretation in future.
