The supervision by public opinion is a kind of social behavior which means that the news media uses the special strength of t he public opinion to help the public to understand government's affairs, social affairs and affairs of involving public interests, impel them to operate along legal system and the direction of social life common criterion. The supervision by public opinion is a kind of important social right, and a kind of important political right too. In our country, with the constant development of democracy and legal system building, the function of supervision by public opinion receives the attention of the party, coun try and people more and more. Have to judicial supervision by public opinion of activity policy and legal basis are but also very essential. But the independent character of the administration of justice and height professional lines of the judicial activi ty make their and public opinion's supervision function produce the contradictory conflict . Because of this, this text has carried on the comparatively overall argumentation to the relation between them. This text come and describe supervision by public opinion relation with judicial independence from four respect mainly. Prove at first that about the basic problem of supervision by public opinion, including the concept, nature, characteristic and historical development; And then expound the fact from the pros and cons that supervise the relation with judicial independence by public opinion; Then analyse the reason why the supervision by public opinion conflicts with judicial independence emphatically; Offer the suggestion of coordinating the two relation finally and the countermeasure.
