On The Legal System Product Liability

With the rapid development of the economic globalization, the frequency of the international trade increases very fast. Accordingly, the issues on product obligations among nations become more frequently as well. In order to protect the legal rights of consumers and make the economy grow up in a health direction, countries begin to seek the methods to solve the product-obligation problems through the legislation for the product obligations. However, the difference obviously appears in the regulations of product obligations among the countries, which is lead by the different law systems, the various reasons for the legislation and the diversified background of the social politics and economy. China started to legislate in product obligation relatively late and it has not become mature until now, hence there are many aspects which need to be improved in the future.This thesis tries to compare the difference in the legislation on the duties of products and products' problem relating to it. It consists of six parts: From part one to part six the following are analysis and studies such as concept, law character of product liability, history development of products, he imputation principle of products liability, the definition and scope of products both at home and abroad.,the definition and norms of judgment of the product defects, the compensation for damages of products liability, the subject of products liability, the products liability cause of counterplea and lawsuit limitation, etc. By comparing these situations above, a conclusion is drawn from the above parts which will gives us some ideas about what we should learn and what will make it perfect for our products liability. facing the chance that our country had joined WTO and go into economy development all over the world, perfect products liability will promote the open Chinese market, promote competitive ability of our products in the world market, promote the development of economy market.
