The crime of introducing bribe was stated as an independent crime in《The 1997 criminal code》.Whether does this crime , however , need to be separated from the bribe crime, what's the difference between them , and how to distinguish this crime with other regarding crimes , these questions have been the focus for a long time . This article begins with the controversy during the legislation , analyzes the necessity of depending from the view of collective crime , then explicates its independent constituting ingredients , and on this basis states its difference with the joint crime of bribe as so as the other regarding crime to resolve the puzzling questions in practice , and finally point out some advices on how to prevent this crime .This dissertation consists of the introduction , main text and conclusion . The main text has six chapters .The introduction part introduces the situation of bribe crime in our country , and analyze the position of introducing bribe .In the main text , the first chapter introduces the legislation abroad . Then starts from the controversy during the legislation in our country , through which brings out the issue on whether to retain it or to get rid of it .Based on the above , the second chapter illuminates the necessity of its independent in the view of collective crime . Then the author proof the conclusion in several other angles .The third chapter regenerates its independent constituting ingredients .The forth chapter analyzes some concrete puzzling question in practice . First , it introduces some issues on whether need to be convicted . Second , it introduces some issues on which crime should we convict . Finally , it analyze some questions that we should convict them as one crime or as several crimes .The fifth chapter introduces the criminal responsibility of this crime .The sixth chapter analyzes the reason by which this crime origins . And on this basis propose some advices to prevent it . The conclusion total the viewpoint above , points out that this crime must be separated from bribe crime so that we can prevent the whole bribe crime better .This dissertation contains 28,000 words , including more than 1,500 words of comment .
