Discussion On Humanization Of Rule Of Law

What is the purpose of human executing rule of law on earth? From the meaning of "ought to be", the purpose of human executing rule of law is human self, happiness and development of human self, and overall cultivation of humanity. Rule of law has been serving human, and is means of human. Rule of law takes specific humanity as basis. Different humanity decides different rule of law, Different rule of law reflects different demand of humanity. Rule of law contains pursuit of humanity, and possesses humanity value. The means of theory of humanity should be applied to analyzing of rule of law. It has essential guiding effect on the theoretical study and practice of rule of law. If the means of humanity is discarded, the foundation of rule of law coming true will be lost. But research on connection of rule of law with humanity has not been systematic still. In order to wholly perceive connection of rule of law with humanity, above all, the whole knowledge of humanization of rule of law self should be achieved. Discussing connection of rule of law with humanity from surface floor of rule of law, the internal connection of rule of law with humanity cannot be realized clearly. So, this paper approaches deep and systematically humanization of rule of law, taking rule of law self as vision and from the point of "ought to be". The main thinking of this paper is, raisingquestion--meaning of humanity and humanization--origin of rule oflaw--Soil on which rule of law growing--soul of rule of law--finalobjective of rule of law. The first part raises the question, and points out the deep theory significance and profound practice significance of approaching humanization of rule of law deep and systematically. The second part expounds the foundation ofthe theory of humanization of rule of law--implication of humanity andhumanization .First, this part, setting out from the viewpoint of practice, elaborates that humanity is property of all of human, and that humanity is the unity of human'snature property, society property, and spirit property, and analyses objective matter characteristic, concrete characteristic, and historic characteristic of humanity. Next, this part explains humanization, and points out that implication of humanization is according to demand of humanity and humanity norm, and availing coordination of conflicts of humanity and cultivating overall humanity, in other words, implication of humanization is taking human as center, essential norm, and ultimate standard, taking satisfaction of need of human's existing and development as purpose, taking services to human as value guide, availing exertion of activity, creativity, and potential, and forming independent personality, and creating condition for overall development of human, and that overall development of human is the highestdemand and the last camp. The third part analyses deep origin of rule of law--conflict and detect of humanity that includes conflict among human's nature property, society property, and spirit property, conflict and detect exist in each property, conflict among individual humanity, group humanity, and kind humanity, conflict among different individual humanities, and conflict among different group humanities, making preparation for unfolding of the latter of this paper. The fourth part, starting from actual human and its life, from the angle that human actual life is source of rule of law and the angle that human pursuing ideal life is power and source of development of rule of law, demonstrates basic viewpoint of theory of humanization of rule of law that human actual life is soil on which rule of law growing. The fifth part, from three aspects: that spirit of rule of law embody ultimate attaching to human's seeking truth, goodwill, and beauty, that norms of rule of law are duplicating and reflecting of norms of humanity, and that the value of rule of law is the care for the value of human, emphatically analyses nucleus viewpoint of theory of humanization of rule of law that humanization is t...
