Because current system of land expropriation formed in the era of the planned economy, the institutional condition and service target which it based on have changed. The inelasticity and hysteresis of the system appears obviously, which aroses a lot of peasants appeal to the higher authorities for help. Considering the system of land expropriation is a public issue which related to various problems in the nearly future, in this paper we mainly analysis and conclude the limitation and shortage of current system of land expropriation. On a basis of this, we approach to table a proposal aim at explaining peasants' land property rights. At the same time, we also try for constructing new system of land expropriation. Consequently we can really protect peasants' rights of land and mostly improve the system.
