The Quotation Responsibility Distribution In The Viewpoint Of Civil Lawsuits

The distribution of quotation responsibility is not only important in the quotation responsibility theory but also very practical. The quotation responsibility distribution theory is, in the final analysis, to serve the practical quotation responsibility distribution issues in the solution of civil adjustments. Based on the exploration of the foreign quotation responsibility distribution schools, the author of this paper holds that the subjectively practical quotation is of more practical values than the objective quotation responsibility in civil adjustment practices. What judges need to distribute is the subjectively practical quotation responsibility. Relevantly, the modes of quotation responsibility distribution are decided by the judges. When judges are judging the distribution of quotation responsibility, they should consider such value factors as value preference, progress justice and efficiency, and social effects of the law of entities, and at the same time attach necessary importance to the applications of such techniques as inference, principles of certainty, apparent proof and proof hindrance to distribute quotation responsibility rationally.
