Thinking From The Angle Of Law On The Supervising Function Of Local Congress

Through the analysis of the history of starting forming and actualizing of the western division of power and representative system this thesis researches the theoretical exploration and practice to the supervising system of the congress representative made by the Marxism and Leninism and the Communist Party of China thereby combs the historical line of the development of the supervising function of the representative organs it also integrates with the historical reason of the forming of Chinese national and local congress system especially the supervising system to set forth the basis legal contents and legal defects of the supervising system of the national and local congress of China from the historical origins Constitution evolvement legal system and real operation situation to reach a conclusion that the supervising system of Chinese congress goes through a process of prospering standstill retrogression hover and progress According to the practice of the supervising work of local congress it points out that the general assessment of the supervising function of local congress at present is there is only supervision but no condition to it so the congress can' t make up substantive condition to the power operation of the government court and procuratorate. On this basis eight countmeasures are put forward to strengthen and improve the supervising work of the local congress from the angle of law.
