On The Right Of Press

It is very obvious that press has played a significant role in life of modern society. However, present analysis regarding the legal position of press made by academic circle is not on a parallel with its important role. For a historical reason, press had been regarded as a politic conception in many occasions, for example, the freedom of press which had been frequently used as a politic conception. When they analyze on the infringement made by the mass media, they generally regarded the media as a place where people can exercise their various civil right. All such analysis has not made their focus on the press itself. In the time when awareness of rule of law has been rooted in people's mind, all important provinces of people's life should be governed by law, without exception of press. The increasing of infringement made by media is a special form of appealing for such realistic requirement.The analysis made by this paper aimed at looking for an appropriate legal position for press so that the media could be protected to function sufficiently and it is possible to prevent media from abusing his right at the same time. This paper comprises three part: the first part has expounded the conception of press. The right of press is a right endorsed to the media in the course of collecting and transmitting news. The second part has analyzed the relation between right of press and power. In the course of establishing relationship with power, right of press is the freedom of press. As it satisfies the requirement of people's right to learn the truth and the freedom of express, right of press also can supervise government. The third parthas explored the problem of the relation between right of press and the other private rights and focused on the relation between right of press and right of privacy, right of fame, copyright. This paper put forward that the reason why the right of press can maintain his position is the need of public interest.
