News Gathering Analysis Of The Protection Of The Right

Press interview right is a right which is closely related to the public right to know and the public opinion right to monitor. At present, there are still no specific laws and regulations which state that journalists enjoy interview right, however, press interview right is considered to be rooted to the regulated freedom and right by the constitution, that is not only recognized in habit and conception but also proved by the laws, it can also be found in some of present laws, regulations and policy documents. Studying and knowing more about the press interview right is to better protect citizens' right to know and freedom of expression, so that monitor of public opinion can be realized.In reality, situations of impinging on press interview right and the conflict between press interview right and other rights occur frequently. To solve this problem, the connotation, extension and features of press interview right need to be discussed, conflict and balance of rights in operating interview right need to be analyzed, present situation and problems in relevant systems of our country need to be explored, beneficial institutional experience abroad need to be learned, so specific institutional design which is suitable for the situation of our country can be raised. That is the very problem that this thesis studies and explores, which is consisting of four chapters.The first chapter starts from theory, quotes discussion from different writers, defines the concept of press interview right, explores lawful characters of press interview right and discusses lawful origin of press interview right, including freedom of speech, press freedom, public right to know and so on, to conclude the value of protecting press interview right.The second chapter starts from practice, analyzes situations that press interview right is impinged on and the conflicts between interview right and official confidentiality, juridical trial, reputation right, privacy right and so on, discusses legalization of recessive interview right. As is concluded, interview right, as constitutional right, actually presents opposed and balanced relationship between public and private benefit.The third chapter clears up the relevant protecting systems of press interview right in present situation, analyzes and studies existent problems, analyzes and compares regulations of press interview protection and restriction, obtain experience and inspire from comparative analysis for helping to build relevant systems of our country.The fourth chapter aims at existent blank in protecting system of present interview system, makes several suggestions on system construction. In this thesis, we believe that press freedom is the fundamental right of the press which should be clear; besides defining special right for news, we clearly define obligations of interviewees. Meanwhile, press and journalists ought to strengthen self-discipline while practicing press interview right.
