The dictatorship system has had its history of thousand years in the world. As whose produce, torture punishment accompanied it go to the end. From the point of ancient criminal, punishment, torture refers to a extreme cruel method executed to body under the legal system. And it realized its efficiency through criminal law and judicial procedure. Which has generated quantities tragedies.Since 13-14 century, the consciousness of "right", "Freedom" and "democracy" enlightened the people, and so propelled the reform of legal system. Anti-cruelty movement began, England and America succeeding legislated the law to prohibit torture punishment.Two world wars bring much pain to the human being, which put the anti-cruelty on agenda.Two conventions about human right were signitured by most countries. China is also willing to accept it and set it a principle to limit the state legislation. And this strengthen the idea of human right in the procedure of judicial.
