Thinking torture in historical view, we can witness its process of evolvement. Extorts a confession by torture was a kind of legal phenomenon, existed for a long time at all times and in all lands. With social progress and development of human civilization, extort a confession by torture has already proclaimed to be forbidden in many countries and is stipulated for the criminal procedural law .Human being put the anti-cruelty on agenda, and the international movement of anti-crucifixion has experienced a course of development and evolution. Many international covenants on human right were signed and ratified. China has also accepted it and set it a principle to limit the state legislation. The idea of human right was strengthened in the procedure of judicial.It is very urgent for China to build a perfect legal system, because there are many extorting a confession by torture in the action of criminal procedural .And any defendant and criminal suspect's rights should be protected.
