Just like national enterprise' one to manage itself freely, university's right to self-running is an essential title endowed by law. Emanating from the "autonomy" of the Mid-Century western European universities, it refers to the quality and ability the university hold to self-determine, self-execute, self-develop and self-restrict regarding the question of how a university can run. With the progressing of the market economy, this right has been finally confirmed and ensured by law.The whole society has paid a lot of attention to and voiced clear opinions about university's self-running from 1980s. With the promulgation of a series of educational law in 1990s such as Education Law of the People's Republic of China and Higher Education Law.of the People's Republic of China, our nation has given this right a clear legal position and range. But under the circumstance of executive decisions and planned economy, China has yet to endeavor to clear away many questions and obstacles that are ideal or legal.To establish a framework to make the execution of the laws, the author researches into the reasons why this right can not come true and bring forward solutions to it. Above all, it should be included in Constitution of the People's Republic of China. Besides identifying the relationship between government, and university and speeding the modernization and transfer of the mechanism of university's self-running by law, we also need to better the system of appraising, monitoring and guaranteeing to ensure the realization and the best benefit of the right. Meanwhile, it's important to intensify the consciousness of legal redress, and we should try to build an efficient supervising system.
