Research On Basic Disciplines Of Emission Trading

Emission trading is a new method of protecting environment in China. There are many cases of environment trading in practice. Many scholars have made much research on it. They focus on these main problems, including, but not being limited to - (1) How about the relations among Sources of Carrying Capacity of Environment (SCCE), Emission trading, Surplus emission permits, Emission trading? (2) What are the basic meaning and feature and applicable condition of emission trading? (3) What is the difference between domestic emission trading in different regions and international emission reduction trading? (4) How to view as those emission-trading cases which are doing in our country? And how to better the system of emission trading? And so on.In the major of this thesis, by using valuable analysis, normative analysis, logical analysis, I discuss on those problems above with some cases. In chapter one the author focus on the main meaning and relations of Carrying Capacity of Environment, SCCE which is belong to peoples who live there, and Emission right which is a specific beneficial property and right to use SCCE authorized by law. In the thesis I study the main meaning and relations of emission permits, surplus emission permits, and emission trading after comparing with discussion of scholars who come from inland and outland, and analyze the feature of emission trading.In chapter two I discuss on meaning and feature and constitution of the legislation relation of emission trading. In chapter three, drawing lessons from CAAA, I focus on applicable condition of emission trading, which embrace dependable institution systems and appropriate natural conditions and feasible reality states. After introducing the origin and development, I discuss on the difference between domestic emission trading in different regions and international emission reduction trading, and the meaning of the former.I discuss on the obstacle of putting emission trading into practice in chapter four. To solve it, we should strengthen local environment legislation and define the function of Environmental Protection Authority. Adopt a prudent policy of emission trading.
