| The crime of corporation is a complicated social phenomenon. Its appearance and development has a close relationship with the development of commodity economy. At present, with the development of market -oriented economy of our country, various kinds of corporation play more and more important role in social and economic life, but also maybe become the subject of crime. So, the study on crime of corporation is very meaningful.The thesis consists of six parts mainly.Chapter one is introduction part, which introduces briefly the possibility of corporation acting crime and the meaningfulness of the appraisal of criminal law on it.Chapter two supports the positive theory of corporation crime, in view of analysis on positive theory and passive theory of corporation crime in China and major countries of continental law and common lawChapter three compares the connotation of "unit" in China Criminal law and that of "corporation "in foreign "corporation crime", and then come to the conclusion that in view of corporation system in civil and commercial law, we should construct the theory of corporation crime in criminal law, and establish the standard of "corporation " identification clearly.Chapter four made a concrete analysis of several kinds of representative views of corporation crime's concept in the theory circle of criminal law in our country, and has proposed new view on that corporation crime means that" corporation 's act, which the internal members implement under the domination of corporation's whole will, and which is menace the society seriously and should be published.Chapter five is a key part of thesis, which analyzes the subject , subjective aspect, object and objective aspect of corporation crime concretely , and focuses on subjective range and crime form of corporation crime especially, and puts forward some new views.Chapter six summarizes the contents said above, against the shortage of the related legislation, and puts forward some legislative proposals on principle...
