Research On The Subject Of The Corporation Crime

The subject of the corporation crime is a new content in the Criminal Law of 1997.This caused many problems of the legal cognizance.There always have many people mistake corporation crime to natural person crime in the judicial practice.Many legal theorists keep attention to the questions of the corporation crime,which make me think a lot.In our Criminal Law,there have many differences between natural person crime and corporation crime.The punishment on the responsible people in the corporation crime is less harsh than natural person crime.This kind of difference needs us to have an earnest research to keep justice of the Law.This becomes a hot topic during the theorists.The precise understanding of corporation crime is the prelude for legislation,which is be the focus of the theoretical arguments.To what extent,the concept is precise reflects the rationality of the legal theories.Judging from above,this dissertation make the concept of corporation crime be one of the researching object.By doing this,the author conducts comprehensive research on the corporation crime through the viewpoint of the study on the concept of corporation crime.The scope of the subject of the corporation crime should be the most sensitive question. It is the focus of the corporation crime in the legal theorist.In the viewpoint of this dissertation,the kind of the corporation crime is company,enterprise,enterprise unit and group.There always have many disputes on that whether the government should be the subject of the corporation crime in the academe.Though there have such rule in the Criminal Law,it didn't carry out in the trial.This affects the authority of the law.Hence,the author suggests that cancel the rule in the Criminal Law.As about the status of the personal enterprise,the author has the viewpoint that it could be the subject of the corporation crime. The personal enterprise has certain capital to take the responsibility in the civil activity on his name.Especially,this dissertation linked to the Corporation Law to discuss the legal status of One Person Corporation.As for the One Person Corporation set up by law,it should have legal status in the Criminal Law,whether it is natural person owned One-Person-Corporation or legal person owned One-Person-Corporation.
