Study On The Legal System Of Environmental Impact Assessment

The legal system of environmental impact assessment has established a new decision-making mechanism, which has renewed the traditional idea and embodied a new way of public decision-making in modern society. This is a kind of democratic and scientific decision-making system. Because it has discarded the singleness, concentration, and monopoly of the power of decision-making, and pursues the decentralization of the power. And it also has changed the old way of decision-making in which only economic and technical elements are considered, and holds that all the relevant elements, such as economic, technical, social and environmental impacts should be included. The article introduces the concepts and theories related to the legal system of environmental impact assessment, and reviews < the Law of Environmental Impact Assessment >of our country at some length. It is divided into four chapters:The concept, characteristics, and kinds of environmental impact assessment are introduced in first chapter. And the first chapter also analyses the purpose of the legal system of environmental impact assessment, and the elements that influence the effect of the system, and the problems that the system meets with in practice.The second chapter expounds the theory of sustainable development, systematic theory and decision-making theory, which are closely related to environmental impact assessment, and thinks that these theories are the theoretical foundation of establishing the legal system of environmental impact assessment.The definition of strategic environmental assessment (SEA) is introduced in third chapter. And the legal situation and practical development of SEA in the main countries in the world are also mentioned.The last chapter reviews < the Law of Environmental Impact Assessment>of our country in detail, and puts forward some proposals that can perfect the legal system of environmental impact assessment of our country.
