The Study On Penalty Of Qualifications

This article, which mainly about the study on penalty of qualifications, is based on a new angle of view .The whole paper can be divided into four parts. The first episode is a brief overview of penalty of qualifications: the definition and characters of qualification, the definition of penalty of qualifications and its history, the legislation and the analyses in several important countries, the system of criminal record and reviviscence, its aims and functions. Then in the second episode, two kinds of penalty of qualifications in China are analyzed one by one, besides this, the rules on penally of qualifications beyond the criminal law, the advantages and disadvantages, presence and voidance of this kind of penalty are all examined. The third episode is about the two principles above penalty of qualifications, such as rule by institutional law and humanitarianism; the historical direction of penalty of qualifications. The last but not the least is some future prospects: improvement of the Domestic Legal system for penalty of qualifications.
