Construction Contract Guarantee/Bond is an important credit instrument toguarantee the performance of a construction contract, and the Employer PaymentBond/Guarantee is one sort of the Construction Contract Guarantee/Bonds in order toguarantee the performance of the employer's responsibility. To solve thenon-payments problems in Chinese construction market, this paper gives aninvestigation on theory of Construction Contract Bond and analysis on characters ofthe Construction Contract Bond System. Combined with the consideration of thecurrent market condition of China, a proposal of applying Employer PaymentBonding System in our country is developed. Firstly, this paper analyzed the actuality and the causation of the non-paymentproblem in construction market of china and introduced an effective method-- theEmployer Payment Bond System, by which the problem upward can be solved. Theobligatory and feasibility of initiating the Employer Payment Bond System aredemonstrated in macroscopically and microcosmic condition On the one hand, by the theoretic investigation,conception and relationship ofsurety bond are expatiated in law field, the mechanics of employer payment bondingsystem is analyzed from the view of information economics . On the other hand , viainvestigation on Construction contract guarantee/bond internationally,and by theinstrument of contrast method, this paper analyzed particularly character and patternof international Construction contract guarantee/bond system in practicing, andsummarized the commonness,which lays a stable foundation for the innovation of theemployer payment bond/guarantee system in china.; based on the introduction of correlation theory of employer payment bond andcompared summarizing to international surety bond system, this paper emphasizesand solves the establishment of employer payment bond system in our country.。according to the domestic executing actuality and juristic fundamental of thissystem ,the article emphasizes and discusses main content of the employer paymentbond system and defines the elementary mode, content of the guarantee andimplemental area and so on, including furthermore, this paper discusses thedifficulties and obstructions of establishment of employer payment bond system in 2aspect of macroscopically circumstance and microcosmic condition, internationaltradition, domestic market, juristic fundamental and construction of interrelatedindustry and so on,and provides the corresponding strategies.
