On The Structure Of The System Of Administration According To Law

Administration according to law is viewed as the basic criterion followed generally while the modern state governed by law is exercising power. The criterion hasn't been followed well considering the present state of administrative law-enforcement in our country though the form of administrative legal-system is consummated gradually. In order to advance the administration according to law all-sidedly and build the government governed by law further, the writer attempts to probe into the structure of the system of administration according to law at dynamic angle. This paper probes into the characteristic of illegal administration, analyzing the issue and reason of system of administration according to law at present. Drawing lessons from Gunther Teubner's theory of "Introspective Mode", the paper comes to a conclusion that administration according to law is regarded as the result of interaction and balance between the government and society by breaking through the existing frame of administrative system. And then the writer suggests that scientific system of administration according to law should be built from constructing interactional pattern , motivating intrinsic driving force and perfecting the system of administrative publicity, which has the characteristics of self-perfection, self-renewal and self-development and suits reform and the situation of opening up to the world constantly.
