Environment is base of human existence and sustainable development of human society. With the improvement of the level of industrialization, the development of human faces lots of environmental problems. Nowadays, environmental problems are very serious in our country, which serious threats to our social security. At the same time, the environmental crime problem is increasingly serious; it is increasing Eco-environmental destruction. As the strongest punishment of law, the criminal law is the last line of defense in environmental protection. Criminal measures are used as a means of environmental protection in China and other countries. Many countries have made certain achievements in the environmental criminal legislation. Rephrasing environmental criminal legislation and solving the problem though the criminal measures can effect on punishing environmental crime and controlling environmental destruction at unique way.This article introduces the concept of environment, development of Chinese and western environmental criminal legislation, analyses the current situation of environmental criminal legislation in our county. Starting from inherent requirements, it explores the problems. This article describes the environmental criminal legislation in Japan, Unites State, Germany and Britain and uses expiries as a reference. Lastly, the suggestions that I put forward in this article include: changing the traditional concept of legislation, taking modern anthropocentrism as value, setting up the special chapter in the environmental crime on legislative style, expanding the environment criminal scope, increasing the new crimes about environmental crime, punishing the danger crime of polluting the environment, increasing the environment crime penalty, improving the types of penalties.
