Reflect On And Reform To The Rights To Collective Land

The rights to collective land in our country mainly include the ownership of collective land and the right to contract for management.Planned economy oriented, the former is quite different from the land ownership in a sense of traditional private right. The latter entitles peasants the right to management land indepently,enabling them to enjoy the status of relatively independent market subjet. This kind of arrangement exposed such shortcomings as weak subject,incomplete right function,which had side-effect on the protection of the right to contract management and impeded the development of agricultual economy. Under this system, rural land is not only a kind of production materials, but also shoulders the function to protect the basic life of peasants. This mechanism requires the equal division in the collective, which impedes the process of industrialization of our country. What is more, it goes againt eqality. Since the ownership of collective land is the source of present problems in rural arears, we should reform such mechanism and entitle peasants the complete right to land, restore its pure function of production materials.
