| In our country, the use of intellectual property has become the most weak section of the national intellectual property strategy. The difficult of management and exploitation of intellectual property, especially of patent, has greatly weakened industrial competitiveness of china. Under these circumstances, it has become an urgent issue for us to search a effective method to manage and explore intellectual property. So, intellectual property trust is coming forth. The utilization of trust system into intellectual property field can not only realize the functions of property management, maintenance and increment of value of it, but also effectively accelerate the industrialization and commercialization of intellectual production. Because it can solve the problem of difficulty in the technological result conversion, intellectual property trust is very significant.Based on inspecting the origin and development of trust system, this paper investigates the character,feasibility and advantage of intellectual property trust in china. Trust law originated from the Uses of the mediaeval England. With the development of several centuries, financial trust has become the trend of trust because it has the functions of property management and financing. Intellectual property is similar to the finance capital, having the Characteristic of "the risk of possesses" and " the difficulty to deal with". So intellectual property also can become trust property.On the other hand, by a empirical analysis of the first patent case of Wuhan and the first case about trandmark trust, this paper analyses the main problem in the intelletual property trust practice in China. The reason is various and the sticking point is the deficiency of the relevant register system. The ideal trust register system is the precondition of trust. This paper discusses the managing organization, content, legal effect of the register system and designs the intellectual property trust register system in the future.
