In the past two decades, the Sino-America trade has made much progress and the trade volume has hit 126.3 billion US dollars in 2003 according to the statistics of China's Customs. However, there appeared some trade frictions between China and the United States in recent years, of which antidumping investigations are quite obvious.According to the statistics of the WTO, the United States of America is the country who has frequently initiated the antidumping actions in the past few years, and China has been the m6st frequent target of these antidumping actions. By the end of 2003, the antidumping cases have reached 107 since the first case-Natural Menthol- initiated in 1980. In the past three years, the antidumping cases targeted China has increased at the rate of 16%, which accounts for its total 55%. These cases cover the fields of medicine, chemicals, textile and apparels, instrument, machinery, and light industry. The results of these cases reveal that Chinese enterprises are in disadvantage. The investigated products have either been levied high antidumping duty or completely driven out of American market. Antidumping has become a major obstacle to the exporting to the United States.With the efforts of GATT and WTO, the tariffs have reduced and the non-tariff barriers will be phased out. Compared with the non-tariff barriers, antidumping has the characteristics of high efficiency, concealment, flexibility, and discrimination. Antidumping will be frequently used to protect their domestic industries by many countries.The large deficit in the Sino-America trade is above one hundred billion US dollais, according to the statistics of China's Custom. The DOC of US will easily approve the AD petition. Additionally, the Dumping and Subsidy Offset Act of 2000,commonly referred to as Byrd Amendment provides U.S. producers with great incentive to file the antidumping petitions. Specifically, the petitioners or supporters of the antidumping investigation that remained in business after the final affirmative determination will receive compensation from the antidumping duties collected by U.S. Customs. It is likely that the number of antidumping actions initiated by America against China will increase in the years to come.It is necessary and of great help to study the countermeasures of the American antidumping with China's entry into the WTO. The whole article falls into five parts. The dissertation firstly explores the reasons, characteristics, trend and the impact on China's economy of the antidumping cases. Chapter 2 lists the resources of American antidumping law and analyzes the theoretical support of antidumping. The antidumping procedure and schedule of the Commerce Department and International Trade Committee of the United States are presented in Chapter 3. Chapter 4 puts forward some precaution strategies, responding tactics, and after the cases how to make the products reoccupy the original markets. In this dissertation, the biggest antidumping case filed by America, China's Bedroom Wooden Furniture, is also included.However, the counter measures of antidumping cannot be completed only by the exporting enterprises. In the conclusion, the author calls on the efforts from the government and the association. Only by the unity of these three parties, that is the investigated enterprise, the association, and the government, China can conquer the antidumping cases.
