Ecological destruction and environmental pollution are two problems influencing the development, resulting in the more and more importance attached to the negative effect of the environment. In the aspect of dealing with the relation of environmental protection and economic development, i.e., the economic sustainable development, the environment property right theory put forward in many developed countries, among which the U.S. is a representative, has solved the "negative external effects" in economic development better, from which we can use for reference. There are four parts in this essay discussing the topic.Part I the design of environmental protection system and environment property right in U.S.The environmental property right has the characteristics of having values, being able to be separated, historical continuity, international allocation and correlating with economy, etc., as a result of which the economic development and growth depend on the definition and support of the environmental property right.The Americans have done better in establishing the environmental protection system, either the environmental protection subject, the environmental protection content, the environmental protection technology, or the choice of environmental protection institution. As a matter of fact, the environmental protection system is a kind of institution arrangement in which the core of the environmental protection is the clarification of the environmental property right, and the efficiency of the environmental protection also depends on the clarification of the environmental property right. It is also the key to make the rights and duties of environmental protection and the standard of rewards and penalties clear.Part II the reasons for laying equal stress on American economy and environmental property right institution.I. the private ownership system in U.S. asks for a clarified environmental property right institution.The social system in U.S. based on the private ownership not only creates the present economic basis, but also plays roles in the field of human ideology, that is, bring about strong private ideology; it is subjectively necessary to clarify the property right, among which the environmental property right is included.II. the American population quality decides the concern on the environmental property right.The population quality not only has effect on the ideology formation of protecting the environment, but also embodies in the aspect of defining the environmental property right from the higher level. The American population quality decides that the humans can maintain their living conditions with the environmental property right.III. the environmental property right can reduce the cost of American economic function.The property right can solve the problem of responsibility. Making the environmental property right clear can reduce the environmental resources in the public field to the full, which means to reduce the values of the environmental resources in the public field, resulting in the restraint on "rent-seeking".IV. the American economic function needs a clarified environmental property right institution.From the angle of market economy, the clearer the property right is, the more efficient the market is.
