The Construction Of Openness Of Government Information Legalization

Comrade Jiang Ze-min once said: "carry out the openness of government information conscientious." at the Sixteenth Representative Conference of the Communist Party of China. Along with the era of information, information, material and energy resources are the three basis resources. As the biggest owner, government should open his information, which is his basis obligation and is the need of realize the socialist democratization. Our country is socialism state of People' s democratic dictatorship, people are the master of his own country and all power belongs to his people, so government should be responsible for the people and be supervised by the people. But people want to exercise of the right of management and supervision, the essential premise is knowing the facts, only knowing the facts, people can supervise the government .The crisis of SARS in 2003 gave us a lesson: we should care about not only the public health mechanism, but also the system of openness government information. Since the Health Department published the information every day , the society become stable, the propagate resource was controlled and the two-way exchange between government and people was promoted . As the same time, the openness of government information legalization is an important part of the openness of WTO. Thus, we should build the system of openness of government information legalization as soon as possible after we enter into WTO. But duo to the traditional and political economy development, there are many problems in the openness of government information legalization, such as the openness content is not complete, people' s right of knowing is not guaranteed, the supervision mechanism is not perfect and so on. In one word, our openness of government information legalization needs perfect. Considering this situation, this thesis makes a comprehensive analysis on openness of government information legalization.Under the back ground of Chinese reform in the domains of politics, economics and society, guiding by Deng Xiao-ping' s Theory, this thesis uses such methods as normative analysis, document analysis. With a thought stream of "raising problems, analyzing problems, solving problems ", this thesis can be divided into five parts:The first part explains some relevant theories of openness of governmentinformation legalization. In this part , it defines the master, the way , the content of openness of government information and explains the idea of openness of government information legalization , then analysis the difference between openness of government information by law and legalization . Finally, this part analysis the basis theory of openness of government information legalization including political foundation, jurisprudence foundation, economics foundation, social foundation, political thought foundation .All these theory are the basis starting part and foundation for studying and solving the problems that will be discussed in the following text.In the second part, it analysis the necessity of openness of government information legalization, it is the requirement of developing socialism democratic politics, of the need of WTO, of combating corruption and advocating probity, of stabilizing the society, of realizing people' s democratic rights and reforming.In the third part, it begins with introducing other countries such as American, Japan and so on, points out the common character and what we can learn from them.The forth part analysis the present situation of our openness of government information legalization and the problems exiting in the system: the content plays emphasis on maintaining secrecy, the way for openness of government information is too little, the procedure is not strict and insufficient in standard and so on.The last part, the most important part in this thesis, is about the author suggestion for the construction of openness of government information legalization.
