On The Bribe Offence

In recent years there exists in China a relatively serious phenomenon of bribe to which the Central Committee of Community Party of China has paid great attention .The quilt of bribing not only gives a bad impression of the Party on the masses but influences our socialism construction whether can further go ahead or not . China has a great number of office staff who possess some privileges, it is hard work that how to guarantee the office staff use their privileges in a correct way.The quilt of bribe has come to growth since there existed private possessions. Whether can we think of it from the angle of human nature or not? Different systems of government and economic operating principles result in different ways and different degrees in bribing, that partially explain the institutional cause. Different areas and cultures result in different bribes, that seems to be related to culture .It seems that the quilt of bribe is not purely criminal offence, which closely relates to system of government, economic system ,culture ,laws and regulations ,even human nature.Based on such systematic consideration, the dissertation includes four sections .The first part states the concept and characteristics of the quilt of bribe .The second part describes the expressions and their characteristics of bribe in China's current stage .The third part concludes the harms and causes of bribe. The last part puts forward to the solutions to bribe.Bribe is divided into offering bribe and taking bribe, taking bribe is mainly concerned about nation's office staff, which is also emphatically studied in this dissertation. With regard to the characteristics about the subjective, subject, objective and object of taking bribe, there existed some changes in their definition in law, at present they tend to be perfect, but there is also something worthy of further discussion.The expressive ways of bribing mainly refer to taking bribe and asking for discounts in economic transaction, the exchange of privilege for sex, the exchange of privilege for privilege, etc. There are new characteristics about bribing in China's current stage: One is varied means of bribing; A second is cases of bribing on the increase and the sums getting larger and larger; Thirdly, the person's position of taking bribe higher and higher; Fourthly, bribe penetrates into politics; Fifthly, the means of bribing more covered.Bribe damages the Party's image and distorts the government's privilege .Thedissertation analyzes the causes of human nature, institution and culture in researching into the causes of bribing. Finally, putting forward to the solutions to bribing: Firstly, innovation in government nation by construction of the constitution and polity; Secondly, build up a fair,open ,efficient and law-controlled government by innovation in the system of government in the system of government by reforming the polity; Thirdly , innovation in culture by refinement of traditional culture, building up the idea of parity ,the culture of honesty and credit, and positive ethical spirit in civil society. Only by such reform and innovation in all directions, our actions against bribing will be more successful.
