On The Insurance Broker's Liability Insurance

With China's entrance into WTO and the development of economy and society, insurance broker's liability insurance has played an important role in insurance market. However, due to various historical and economic reasons, the theoretical research about insurance broker's liability insurance is too simple and insufficient, which confined the development of broker's liability insurance. The author elaborated the whole system of broker's liability insurance through comparing the theory concerned and measures adopted by different countries , which aimed at providing legislation suggestions and promotion the development of whole insurance market.This article includes five chapters. Chapter One mainly introduce the general theory about insurance broker's liability insurance, particularly its conception,its development history and its significance. Chapter Two analyzes the insurance object of insurance broker's liability insurance, namely insurance broker's liability which includes tortuous liability and liability for breach of agreement. Chapter Three elaborates the liability limits of insurance broker's liability insurance.Chapter Four mainly suggests that our country should establish the legal system to strengthen the third party's interests protection through the third party's direct requesting rights. Chapter Five expounds the liability insurer's right for participation in compensation and his liability of defence.
