Building up legal belief in students' minds is one of the goals "and assignments of higher legal education. Since law subject was founded, legal belief has become its necessary things. Higher legal education ought to meet this characteristic and* take legal belief for its responsibility and important assignment. Nevertheless in practice it's not so. There is instrumentalism in higher legal education from the beginning. This theory ignores people's inherent value and initiative characteristic. It considers that people is instrument or vassal of social evolution. Now this acquaintanceship has shown its deficiency though it prevailed at one time. Not only does it not meet the needs for the social development but also inhibits people's dreams'and demands. Thus, higher legal education not only trains students' technic rational thoughts but also cultivates legal belief as it is a teaching goal. One side higher legal education must pay attention to impart theoretic knowledge, law's material operation and practicing taches. On the other hand it must study foreign advanced teaching practice. In this way, students can experience the law's values and comprehend the law's spirits. Also only in this way, the students ultimately can form correct cognition and rational evaluation about the law. This is the fundamental approach of cultivation of legal belief in higher legal education.The article discusses the cultivation of legal belief in higher legal education from four aspects. Firstly, it introduces the elements of legal belief. Secondly, it clarifies reasons of cultivating legal belief they are characteristics of law subject, requirements of higher legal education and law's operation. Thirdly, it opens out disadvantages of instrumentalism in higher legal education. Finally, this article indicates the fundamental approach that is the experience of law's value. And on this base, it brings forward the basic conceits of teaching methods of cultivating legal belief.
