Research On The Relevant Legal Issues About Culture-Oriented Travel Industrializaion Of Ethnic Minorities In China

In recent years,the culture-oriented travel industrialization of chinese ethnic minorities has been developing rapidly.However,its development still has hampered by lots of passive issues due to the reasons of history and economy etc.And the relevant laws and regulations are still incomplete is the most fundamental constraint.Without reasonable law system that can be as a safeguard,the industrialization won't go to the way with high efficient operation.Nevertheless,the industrialization is an important measure to protect splendid culture of ethnic minorities,and promote economic development of ethnic areas,therefore, we have to formulate the perfect law systems and operation mechanism which are relevant and belong to realistic society.First,this research has defined the relevant concepts from intension to extension on the basis of fundamental theories about the culture-oriented travel industrialization of ethnic minorities.It also has analyzed the theory subjects,of a harmonious society,interests and benefits system,the theory of sustainable development,the theory of co-ordination of supply and demand,the theory of industrial economics and costs and benefits.All the theories come from law and economy subjects which are the theoretical principle for researching on the relevant legal system.Second,this research has analysed objectively about the relevant legal systems of typical region and countries from Europe,America and Asia.Meanwhile,it has summarized experienced ones which are fit for out country's reality to study and use as a source of reference,including protecting the ethnic minorities'right of language,the economic right of traditional cultural heritage people and guaranteeing capital investment by legal system.Third,it has made a study of the relevant legal issues and other problems aboat culture-oriented travel industrialization of ethnic minorities in China.They include an absent basic legal of culture industry,the relevant rights and interests of ethnic minorities that the law should protect are absent,management mechanism doesn't work well,the national culture property are unreasonable,inappropriate resources development,the industry brands are shortage,lack of adequate infrastructure investment.And it also has analyzed the causes of these problems.Finally,on the basis of the issues of industrialization and the advanced experiences from abroad,the study has fully utilized various theories and put forward the basic principles that the relevant legal systems should follow,including four cardinal principles,they are benefits balanced and sustainable development,community participation and support through subsidies.Lay heavy stress on how to rebuild the relevant law system,including the design of the route of specific economic subject legal system,the macroeconomic regulation,market regulation and reconstruction national cultural property.And it also puts forward the relevant environments should make better for the operation of relative legal system,including good social environment to guarantee the legal system has played a perfect role,favorable investment environment,an actively promotion for intellectual property protection and the talent training scheme.Through the regulating of legal system and operation mechanism,the resources of tourism can be effectively exploitated and utilizated, the ralated rights of ethnic minorities also can positively to be protected,and the issures of will be settled to enhance its competitiveness,Making sure the culture-oriented travel industrializion of ethnic minorities towards the path of sustainable development.
