Espionage has a very long history, since and between the beginnings of the countries and international relationships. As an important but vague part of the international relationships,on the one hand, espionage has never been prohibited by the international law in written regulations or treaties, highly organized espionage always being taken by the nations as a systematic approach for the national security and development; On the other hand, for the national security also, anti-espionage is a crucial part of the national defense, and espionage will get a hash punishment by domestic criminal law. For sure, the dilemma above was caused by the complex disputes among national interests, national sovereignty and international relationships which will not be easily solved. This article focuses on the basic regulations and fields in the international law.Chapter 1: This Chapter gives the basic definition of espionage both in lingual and legal fields, the basic understanding about espionage by the author will be given too. Espionage's history will be briefly told for knowing espionage better.Chapter 2: As an regular operation in the battle, espionage is legal in the international law on battle fields. For discussing the espionage in this field, the basic regulations in the international law in war and international humanitarian law will be discussed for clarifying the position of the individual involved in espionage (Spy).Chapter 3: As an uncertain area in the peacetime international law, espionage in the peacetime is hard to get a clear position. The basic theories of human rights, sovereignty and national responsibility will be involved to analyze the real position for the espionage.Chapter 4: Focus on the many sensitive and important territories which espionage happens, in order to discuss the popular espionage news happened in China and International Society to make a conclusion in details.Chapter 5: In the UN collective security defense system, sovereignty will be diluted in certain situations. UN Security Council is the core of this system. The accuracy and independence of its intelligence is critical. Espionage for one country's interest only should be abandoned. In the future, the anti-terrorism and anti-pirate will be more and more important, international intelligence cooperation is an effective and constructive way.
