A Comparative Study On The Legal Regulation Of Economic Espionage

In recent years,with the frequent occurrence of economic espionage cases,China has entered an important period of expansion of national interests.With the deepening development of reform and opening up,China's economic construction has made tremendous achievements,China's international status has been continuously improved,and it also has a place in international competition.However,economic development and the improvement of international status have also brought a lot of problems,national security.The whole issue is a new challenge.In the new historical period,China is facing unprecedented security problems,which are more complex than any other period in the past.Especially in the field of economic security,various economic espionage acts appear in commercial activities,causing huge losses to our economy.Today's society is in the period of economic development and international competition in the fields of economy and science and technology is becoming increasingly fierce.Various enterprises and organizations at home and abroad are more and more interested in trade secrets.Economic espionage is on the rise.The term "espionage" no longer refers only to political,military and front espionage,but gradually develops to the economic field,and China's economic security has also been subjected to.The great threat of economic espionage.With the occurrence of theft and leak of a series of important resources such as more and more countries,enterprises,personal economy and technology,resources,formulations,products,etc.,economic espionage has caused huge economic losses to our country,has also caused survival crisis to various enterprises in our country,has seriously damaged the order of our market economy,and has hindered me in technological progress and capacity innovation.The development of our country breeds corruption of public officials and managers at all levels of enterprises in our country,which seriously endangers the national economic security and core interests.Therefore,the relevant legal research on economic espionage is particularly important.Starting from the typical case ‘Li Tuo' in 2009,this thesis will present a clear difference between espionage and economic espionage,between economic espionage and traditional one,between national secrets and commercial ones.Then,there willbe a detailed study into relevant laws and regulations on national economic espionage,making analysis and comparison with the laws in the foreign countries,especially focusing on ‘The Economic Espionage Act' in US.Finally,a range of corresponding suggestions will be given to build the so-called ‘Great Wall of Steel' in economic security.
