Our country has always attached great importance to the three rural issues,from 2004 to 2010, the CPC Central Committee on the 1st documents were focusing on three rural issues. Agriculture plays a fundamental role in national economic development.Land is the foundation of agriculture, and land transfer is an important form of the industrialization and scale of agriculture, while the path is an important part of the land transfer, so exploring the path of land transfer plays an extremely important role for standarding land transfer,the promotion of rural economy and even the economic development of the country. But now, the land transfer is speeding up, the coexistence of various forms, the path of land transfer is still not standardized in law and practice, and the controversy in land transfer is numerous,which seriously hindered the rapid transfer of land, standardized transfer and scale transfer. So we urgently need improving the path of land transfer.In addition to the introduction and the epilogue, it is divided into three chapters. The first chapter is to explain its meanings, characteristics and related notes in our current law,practice and theory as a whole,providing a theoretical basis to the below. The second chapter is to explain our existing pathes of land transfer and the controversial pathes of land transfer, using methods of comparative analysis and practical analysis to clarify the author's point of view, providing theoretical and practical basis for below. The third chapter firstly is to present the right path proposal in the legislative, and then use methods of the combination of theory and practice to analyze a typical case in practice and innovation systems, and to provide ideas and references for our exploration to land transfer.
