At present, the international legal regime governing space activities are the Outer Space Treaty, Rescue Agreement, Liability Convention, the Registration Convention and Moon Agreement five international treaties concerning the registration of manned spacecraft, damages, rescue the astronauts and other requirements. The development of manned space flight and manned spacecraft of the commercial usage, to the existing legal regime of space has had an impact. This is mainly as follows: the concept of manned space activities related to the definition is vague, the definition of space object has been unable to cover the characteristics of the manned spacecraft; rescue a single object, the lack of space than the astronauts persons other than legal protection mechanisms; information registration system is not clear enough. And criminal legislation on space is still empty. These problems make space activities in disarray, unable to meet the needs of maturing space.In response to these problems, we should strive to perfect the legal system of manned spacecraft. At the international level, the international community to strengthen legislation to further clarify definitions, clear space objects and the relationship between the manned spacecraft, to better regulate the activities of Aeronautics and Astronautics. In addition, expanding the scope of interpretation of the astronauts in outer space to achieve the full protection of personnel to meet the commercial development of manned spaceflight. In regulating the obligations of launching manned spacecraft, the launch should encourage States to launch information related to the registration system was further refined to ensure the emission behavior in the international supervision. Criminal offenses against outer space, the international community should draw on appropriate development of air transport experiences of international legislation to combat the threat of international conventions crime in outer space.China as a rising power in aerospace technology, in compliance with current international conventions on the basis of domestic legislation should be strengthened, coordination of international, relevant domestic laws, development of space activities of our country. In particular, should begin to develop administrative regulations, and gradually space planning legislation into national legislation to achieve the full specification of the manned space flight to promote the rule of law in China's space strategy. |
