Conception Of China’s Manned Space Flight Legislation

Recently, China constantly make achievements in manned space flight industry about science and technology, at the same time, the development of manned space flight exceed backward legislation. Lots of experts has carried on releva nt research about this phenomenon. But the achievements largely focus on aerospace area more than manned space engineering. So this paper devote to study the importance of manned space engineering legislation and make some suggestion about China relevant legislation.This paper adopts method of comparative analysis and law interpretation. On the one hand, make comparisons about domestic law in different countries in order to accumulate materials for writing. On the other hand, analyze the meaning and function of law for ideas bout China manned space engineering legislation.The achievements of this paper mainly reflect in three aspects. First of all, manned space flight is under the control of international treaties, especially Inter Governmental agreements which is the first agreements about international space station. However international treaties have revealed disadvantages when dealing with outter space disputes, including fuzzy definition, lack of practice possibility, imcomplete dispute settlement mechanism. It is necessary to fill the blank of international law by domestic legisaliton. Secondly, the United States, Russia, Canada and Japan all have abundant domestic law about manned space flight and legislation pushes development of aerospace industry. The modes of legislation in the United States and Russia are inverse. China could adopt legislative modle of Ruissa and make use of advanced legislation technology, especially in commercial launch, international space station and international cooperation. Finally, there is no legislation on manned space flight in China at present, fundamental and general manned space flight legislation based on policy, bilateral cooperation and space objects registration regulation. This reasearch starts from ten aspects include objects, range of application, registration system, rescue system, intellectual property, qualification system, compensation system and insurance system, international cooperation and legal liability to draft law which is a conclusion to research.
