The health care product as a kind of product is fashionable quickly in commodity market of our country in recent years. It had a rapid speed of evolution in a very short time. The main reason is the key role of the advertisement of health care products. We can say that if there is no the add fuel to the fire of the advertisement to health care products, there will be no the fiery spectacle of selling from day to day. The health care products take a significant part as a special product in our commodity market and make sure that the advertisement of it should be supervised as a propagandistic. In view of the overflow of the deceptive advertising in our market and it making consumer's lawful rights and interests into damage, breaking the order of the market. In this situation, the laws and situations should be take several kinds of method to take charge of these unreasonable situations, because this is the urgent thing which concerned the stabilization of our market in recent times.Consumers take a very important part in market and they are the potential maker of the laws among it. They should have the substantial power to make the decision of the operation management that belongs of the management. But nowadays the situation of our market economy in our country, there is a reduction of tendency among consumers in common, the most obvious manifestation is the shortage of the succour of rights and even no punishment to the invaders. Among the invading of the deceptive advertising upon consumers, the situation of it is in common and become more and more critical. But the cases that the protection and the sufficient compensate to the consumer are really seldom to see. Now the shortage of the rights and interests to consumers are in the emberrassed situation in recent years and even no measure to solve it. There is a close contact of the reduction of consumers and the running wild of the deceptive advertising. More invade and less remonstration. The unequilibrium right among producer and consumer raised again in our market. The law to the protection to consumer be trampled and the authority of law be blasphemed. There should be some methods to change this uncommon economic situation.There are several different kinds of conflict between the regulation to advertising of health care products and protection of consumer rights. The aim of this conflict is to find out the link between the regulation to advertising of health care products and protection of consumer rights that would be more feasible and operational. The research into the method about how to solve this question and the theory should not be limited whine domestic law, the important reference material are the advanced legislative experience and consummate legislation. Since the reference of legislation, the extent of research should not be limited to domestic, the reasonable way is to make innovation and progress by ourselves. We should make the mechanism of our legislation that fit the practical situation of our country and can break the frame of ourselves. We hope that there will be win-win between the health care products and the consumers. In view of this situation, we take a research to the regulation of the health care advertising and the protection of consumer, We president the legal method that have the practical significant, We hope it will provide the pointcut for future legislation.
