Legislative Protection Of Traditional Knowledge In Minority Nationality Regions

We have five thousands history in our country with an ancient civilization and 55 minority nationalities of it. Each one of 55 has a lot of traditional knowledge. Production of the traditional knowledge is closely linked with the interests of developing countries. So they were toke part in the related international conferences positively.And some of them have related legislation. But we do not protect our traditional knowledge in the theory and the practice. We have an advantage in this area, as traditional medical science (the Zang medical, medicine and prescript of folk medicine), Plant Genetic Resource, Plant Genetic Resource, and so on. They have no value, we must protect it. We have made fewer working about it in our country as in the international. There are twenty years in the protecting with different minds, as there are no one mind can be accepted with everyone. So it is very important to research it.In this paper, we are researching it with four aspects. First, the sketch of traditional knowledge. Second, the conception of the traditional knowledge and the relationship with the non-physicalheritage.Third, the principle and the substance of the area of regional national autonomy. Last, have some examples to the legislative protection of traditional knowledge in international and have the methods to our country. The main methods are:firstly, improve the intellectual property institution. Secondly, set up the specialized intellectual property institution. Thirdly, combine the traditional knowledge and the science of today. Fourthly, the protection of traditional knowledge. Lastly, put forward a suggestion which I agree with it.
