In recent years, China's food safety incidents have been causing concern with the whole society. The laws system used to prevent unsafe food with legislation regulation. However, with the improvement of people's living standard, the requirements for food safety change from the need for food to the need of the safety, nutrition and the pluralistic value. The requirement for food safety has also changed from supervision afterwards to establish source prevention system in advance.Japan has been recognized as one of the most perfect legal system of food safety accidents countries in the world. For our idea of progress in food safety laws, Japan's experience has a lot of will help a lot to perfecting the legal system.This paper will be divided into four chapters,The first chapter compares the two countries'food safety legislations and the process of evolution to study the different legal system comparative research and the two countries legal structural characteristics.The second chapter basically is the comparison of food safety supervision system. Especially from the food safety commission system, legal system, coordination and crisis management information system, etc.The third chapter is about the comparison of food safety prevention and crisis management system, this paper argues that Japan "separation" type of risk assessment and monitoring system, effective, is worthy of our reference; Japanese food safety risk analysis system, promote the information system risk sharing and coordination. In the comparison of emergency management system, China's legal system is not perfect for relying mainly on the power of the government's orders. In short, China hasn't established the concept concerning a lot from the food source on the supervision of food safety, which left far behind of Japan.Chapter four is combined with the comparison from on macroscopic to discuss our food safety work of enlightenment.
