The Perfection Of The People's Jury System In The Perspective Of Judicial Justice

Born in 30's of the 20th century, the People's jury system has passed a course of more than half a century. Its historical development can be deseribed as full of twists and tums. Entering the 21st century,especially from the 11th session of the 10th NPC standing committee on August 28 in 2004 when the"The decision on improving the People jury system"passed( It is referred to as the"Decision"in the following text), the People jury system has been a very hot issue both in legal field and in judicial practice. Currently, the study on the People jury system is not uncommon. However , the paper concerning the relationship between the People's jury system and judicial justice and the mutual promotion mechanism is relatively rare. Although there're differences between our People jury system and the western jury system in many aspects, say the origins and the forms, our People's jury system contains the spirits of judicial democracy and the balance of power, which are indispensable to the judicial justice. The thesis analyses the positive significance and the negative factors of the People's jury system in China from the intrinsic connection between the judicial justice and the People's jury system .The suggestions for the reform and perfection of the people's jury system are thus put forward. The thesis is composed of six parts: the first part introduces the topic of the paper; the second part summarizes the elements and the connotation of judicial justice;The third part describes the positive role played by the the people's jury system in defending the judicial justice;The fourth part explores the situations where the people jury system plays an important role to the judicial justice by analysing the historical development of the people jury system and comparing the western jury system with it ;The fifth part indicates the negative factors of people's jury system to the judicial justice and briefly analyzes the reasons to that;The sixth part puts forward the reform and perfection suggestions for the people's jury system concerning its influences to the judicial justice.
