Social organization has been developing rapidly since 80's of 20th century. Mr. Annan--Previous secretary of United Unions once empasized in the UN Conference: there are three most important strong powers in the activities of the world political platform. First is government, second enterprise and the third is social organizations. Obviously, social organizations have become the third most essential power, following government and the enterprise, in current internal society, with a more and more important role in the social issues. As the continuous setup and improvement of our socialism market economics, the government is now changing from Limited-Function to Multi-Functions, thus provides a wide and broad system space for the development of social organizations. Social organizations can on one hand effectively make up for the defects of inefficiency of the national systems which works as the first department and carry on all those functions of Limited-Function governments as well, on the other hand it can conquer the defects of inequity being arisen as market system and then solve the self-benefit problem of the market.Nowadays, social organizations are playing more and more important roles in all aspects of the economics, social and production life. Thus provides good opportunities for us to enhance the social organization legislation, to provide benign legislative environment for the healthy, well-ordered and sustainable development of social organizations.However, the social organization legislation of our country is now seriously lagging behind actual demand, its guiding ideology is deviated, the legislation is with vacuity and low level. Due to various defects in the social organization legislation, it is of great difficulties to guide and regulate the development of social organizations which then arise abnormal social organization development. "Three more and three less" phenomenon is accordingly resulted:first, more administrative social organizations and less non-government social organizations; second, more non-public-welfare organizations and less real public-welfare organizations, third, more obturate social organizations and less open organizations. The above mentioned phenomena could hardly improve the prosperous development and growth of the social organizations, could hardly guarantee the realization of the citizen right to form associations that is stipulated in The Constitution of PRC, and could hardly exert its functions to boost economy and society development as well as to accelerate democracy establishment. It is now urgent to strength social organization legislation, to make multidimensional laws regarding the legal position, right and obligations, activities patterns and supervisary administration, etc. In the current days, social organization legislation has become one of the important and organic part of the legal system of many countries. Therefore, China have to draw on the experiences of other countries, combining with the reality of China, to consummate related lawmakings, to bring the social organization development into legal channel, to constantly perfect legal environment of the social organizations and to thoroughly make use of the special functions of the social organizations in the fields of improving Chinese economy and social harmony.This essay analyses in details about the definition and identifications, features and classifications of the social organizations, the necessicity of social organizations legislation, the essence of legal theory, the development of Chinese social organizations and legislation history.
