Research On Some Legal Problems Of Inheritance Notarization

ABSTRACTInheritance system which appeared accompanied the family and the private ownership is an ancient legal system。From the legal merit, inheritance contains the broad and the narrow meaning, the broad one refers to the living one inherit the dead one's rights, include not only property inheritance but also status inheritance。In the modern law, inheritance is interpreted narrowly, specifically refers to property inheritance, which means a legal system when the property owner dies or declared to die, the property and its rights.left by the dead transfer to the successor in accordance with the law or the will。The inheritance system plays a very important role in consolidating the system of economy and society, promotion of the harmony of the family and the construction of a harmonious society of socialism.The "INHERITANCE" enacted and implemented in China in 1985, "INHERITANCE" adapt to the Chinese situation。After twenty five years, Chinese society differs from the past largely, the power of comprehensive national increasing, the legal system continuously improving, the legal awareness of the citizens enhancing, and personal property of citizens increasing rapidly。The nation pays more and more attention to protect the personal property of citizens. The number of Inheritance matters are increasing more and more。In practice, many heritage inheritance need to inheritance notarization, so notarization sector become one of the most "Inheritance" utilizing department。I work in a notarization sector, who has deal with a large number of inheritance notarization, particularly property inheritance notarization。In notarization practices, I found many necessary changes and improves in "INHERITANCE". There are some specific problems brought to dispute in the notarization area. This article aims to discuss five parts:subrogation inheritance exists or not after inheritance transferred; the character of testament to the grandchildren; the comprehension to Article 29 of "Property Law"; the property inheritance notarization; the protection to the interests of the creditors of the decedents.
