Study On The Legal System Of After-Legislation Evaluation

In recent years, Chinese legislative main have actively explored multi-ways to promote the quality of legislation. In a broad sense, the legislation process arguments believes that the after-legislation evaluation is the most important part in legislation processes. At present, the study on the system of after-legislation evaluation is still at an early stage, the vacancy of practice and research make the study on this system not be agreed by people.On the basis of the introduction of this system and reviewing the practice of this system at home and abroad, this thesis will pay emphases on the building of the system in our country. Foreword not only briefly introduces the current activities and the importance of after-legislation evaluation, but also clearly shows the way of writing of the full text. Apart from the preamble, the text is divided into four parts:chapter one will discuss the concept of the after-legislation evaluation system. First will analysis the difference understandings of after-legislation evaluation in this area, and will definite what is after-legislation evaluation, and at the same time, we will find the features of after-legislation evaluation. In the last part of this chapter, the author will reveal the theoretical basis of building the after-legislation evaluation. The second chapter reviews the development of the after-legislation evaluation in our country. This part mainly introduces the practices after the carrying out the after-legislation evaluation, reviews the present situation of this system in our country, and concludes the deficiencies of present after-legislation evaluation. It stresses that it needs to give its institutionalize norms and guidelines as well as to provide practical support for the follow-up chapters. Chapter three will build a scientific and reasonable after-legislation evaluation in our country, including evaluation subjects, evaluation objects, evaluation standards, and evaluation procedures, to put the after-legislation evaluation on a legal basis. This chapter will firstly borrow the legislation of the after-legislation evaluation form some foreign countries, then build the after-legislation evaluation of our country from the four aspects, i.e. build a same evaluation standard, a multiple evaluation subject, reasonable evaluation object and perfect evaluation procedures. The forth chapter will analysis the feasibility and necessity of the after-legislation evaluation in our country.
