Study On The System Of After-Legislation Evaluation

In recent years, Chinese legislative main have actively explored multi-ways to promote the quality of legislation. The system of after- legislation evaluation is one of these. It is one of important process of legislation. On the one hand, as a highly technical means, it improves the quality of legislation and sustains rational decision-making of legislation by evaluating the implementation of the relevant regulation. On the other hand, as an important attempt of scientific legislative measure, it is an expression and development of democracy, the rule of law and human rights in the vision of constitutional construction. At present, the study on the system of after-legislation evaluation is still at an early stage, the vacancy of practice and research makes the study on this system generally recognized.On the basis of the introduction of this system and reviewing the practice of this system at home and abroad, the article pays emphases on the building of the system in our country, including the principles, the criteria and so on. Foreword not only briefly introduces the current activities and the importance of after-legislation evaluation, but also clearly show the way of writing of the full text. Apart from the preamble, the text is divided into four parts:Chapter I introduces the system of after-legislation evaluation. With the background of current situation of this system, author describes its theoretical basis and necessity, defines its concept, states its character and reveals its significance. This chapter aims to give readers a correct cognition of this system as well as to provide theoretical support for the follow-up chapters.Chapter II reviews the practice of this system at home and abroad. Section I introduces the practice of this system in the British, Japan and South Korea, then summery their advantages. Section II provides an overview of this system in our country, and stresses that it need to give its institutionalize norms and guidelines as well as to provide practical support for the follow-up chapters. Chapter III gives a comprehensive, innovative construction of a scientific and rational system of after-legislation evaluation, including evaluation subjects, evaluation principles and so on. Author innovatively introduces the concept of 360-degree feedback to the evaluation system to build a 360-degre system of evaluation subjects, and introduces enterprise balance mark card to build a dynamic, open and advanced system of evaluation criteria. Then on the basis of the practice of Qingdao and Shanghai, author concludes the evaluation objects and evaluation procedures and relative problems.Chapter IV discussed the inspiration of this system in the vision of constitutional construction. Section I provides inspiration from the perspectives of democracy, the rule of law and human rights. Section II discusses support and correct understanding with the background of the pursuit of constitution. Under the framework of "legislative law", author describes this system by using the legislative languages. Then author stresses the importance of the early stage of legislation for improving the quality of legislation.
