Study On Guarantee Of The Civil Rights In The Process Of Media Supervision By Public Opinion Currently In China

In contemporary China was against the background of social transition .The level of social and material production was raised .Accompanied with the progress of the citizens' consciousness to safeguard their rights .Constraining the operation of public power ,holding public officials back from dereliction and corruption through kinds of supervisions is an effective means for the citizens to protect their rights .Media supervision by public opinion is recognized for its advantages of being convenient ,fast and high-impact. It becomes an important form to achieve the expression of citizens interests,and to guarantee the civil rights .Systemic studies on media supervision by public opinion guarantee the civil rights ,in order to regulate its act and achieve the citizens' interests ,plays an irreplaceable role in advancing the process of China's democratization and legalization .This article starts from this point ,using the method of interest analysis ,to study on this question from four parts:In the fist part ,we introduced the basic theoretical framewok of guarantee of the civil rights in the process of media supervision by public opinion .Mainly analyzed the concept of civil rights from the perspective of civil rights .Then ,the direct and indirect means to safeguard the civil rights .Elaborated the intrinsic link between supervision by public opinion ,media supervision by public opinion .Analyzed its concept in the respects of essence ,subject ,object ,ontology ,content ,form ,and quality .Introduce its premise .Descripted its relationship with guarantee of civil rights .Summarized its feature of authenticity ,objectivity ,openness ,and wide coverage ,timely ,efficient ,is "soft power" .Finally ,summarized its role to guarantee civil rights from four respects :to promote the party and state's policy made and implementation toward science and benefit citizens .Being benefit for preventing and containing corruption of party members and public officials .To prevent the incidents of infringement civil rights .To promote citizens' participation and discussion for politics .To provide public feedback to government .To advance the process of China's democratization and legalization .To promote rational resource integration and maintain social order stably .In the second part ,we introduced the developing history and achievement of guarantee of the civil rights in the process of media supervision by public opinion .In respect of developing history ,mainly overviewed the exploration in the field of practice and theory on guarantee of the civil rights in the process of media supervision after Communist Party of China was founded, in particular the after the reform and opening up .The its process of legalization .Especially in the realm of theory, the promulgation of policy documents and relevant laws and regulations from the CPC Central Committee and state ,provided policy conditions to safeguard civil rights for the media supervision by public opinion . Local laws, regulations and industry standards provide a legal basis and experience in preparation for its development .However, the lack of a comprehensive, clear, workable law is its "bottleneck" for its development .Despite facing many difficulties, after thirty years' development, through the sophisticated legal means to regulate it in order to achieve civil rights protection is also just around the corner .In terms of achievements, mainly on its exercise of public power constraint, correcting the behavior of public officials, urged the country's improved public management practices and improve the living conditions of vulnerable people.In the third part ,we revealed the problems of guarantee of the civil rights in the process of media supervision by public opinion .Such as economic sources independent led its dependent on public authorities .Political dual status led to it can not master the "moderate" principle in practice .The absence of legal norms led to its boundaries unclear .Cultural understanding is not in place led to its difficulty carrying out .The protection of itself also affected the protection of civil rights .It and other form of supervision is not in a good combination led to its lack of sanctions.In the forth part ,we proposed the solutions to the problems of guarantee of the civil rights in the process of media supervision by public opinion .Including the encouragement of private capital involvement of journalism. Appropriate to relax the policy of self-management for the news media .Regulate news media's double identity, dealing with the relationship between citizens, public power and the news media .Establish news laws and regulations, optimize its legal environment .Strengthen cultural education and advocacy, promote correct awareness of it to form .Improve quality of journalists, establish its feedback mechanisms .Made combination to it with other monitoring form ,to improve its power.The innovation of this paper is that the use of Marxist interest analysis means, the use of bottom-up path to study the role dual nature media supervision by public opinion in protection of the civil rights plays. To come to the conclusion that we should standardize and promote media supervision by public opinion comprehensively. In order to make contribution to Chinese political democratization, and legalization process.
