Law And Body

The author tries to study how the legal system constructed and operation through the relationship between law and body. Full paper is divided into five parts, introduction, conclusions and three chapters of the text.In the first part, I describe the history of philosophy concerned with the body theory. This article does not intend to discuss the body theory from a philosophical perspective. Describing the body changes in the history of philosophy is to show that we can study law through the analysis of the relationship between law and body. Jurists have had relatively less research on this. In addition, the introduction also clear the connotation and extension of the concept'body', which is the foudation of this paper.The first chapter is used to describe a static legal system, which the law draws the body into its regulation system. The second and third chapters are used to describe how the body's regulation system operation from a dynamic point of view. In the beginning of the first chapter, I decribe the legal status of the body in histroy. In traditional Chinese society, the individual's body was under grading system and family doctrine, which causing different people's bodies were treated differently. In modern society, civil system are established universally. which is the results of long-term evolution of the body-law system. Chapter II is used to analyze the operational status of the law from the view that law oppresses body. There are virous ways that law oppresses body, and most penalties role on body directly. This chapter is used to explore the details of the operation of the law from the corporal punishment to imprisonment, as well as how the legal system is constantly self-adjust to changes in the environment. In addition, the law is not only a suppression of the body that can be seen on the body punishment, but also includes social discipline which people are not aware. This chapter also will integrate the relevant theory, to discuss the abstract sense of the legal discipline on the body. Chapter III will explain the operation of the relevant legal system from another angle that the promotion effect of the legal to body . This chapter includes how law protects body, the law restriction of death penalty, and social security law and sport law to keep body heathy and strong.The last section is conclusion. The title of the paper is Law and Body, but this paper is not intended to explain the relationship between the law and the body, but with the analysis of this point of view, through a series of laws and body systems'description and discussion, to analysis the legal system operating conditions and the effectiveness of the legal system itself. According to the article, the law is a tool for maintaining social order. All the paper is used to explain how the law completes its goal, both in how the legal system to build, but also how the legal system to run.
