In the development of constitutionality in China,Judicial Circuit System hasgone through a process of construction to development,from being weak to beingrevitalized.This development is closely related to the change of various social factorsAll laws regarding circuit justice only have a general definition of this phenomenonHowever,in reality,various kinds of circuit justice would appear under differentcircumstances in different districts.Although circuit justice does not have an existing,feasible and normative working procedure,the frequently used working mode inreality is"to circuit to hear appeals,to hear trials locally,to dispose cases with thepriority method of mediation,to give directions to the work of people'S mediationcommittee".Circuit justice fully represents the principle of"facilitating action ofparties",which not only eases the burden of litigants,embodying the spirit of"realizing justice for the people",but also makes a better use of judicial resources ofcourts.Today'S circuit justice of China is neither a duplicate of the one inAnglo—American law system nor an imported one from westem society;it is neitherthe same with the one in ancient China nor the inheritance of tradition;it originatedfrom"the judicatory style of Ma Xiwu",but it is not the simple copy of the latter.Itinherited the characteristics of"the judicatory style of Ma Xiwu",that is,simplicityand convenience,but substantially it is the product of analysizing and interpreting it.Therefore,as a way of trial,today'S circuit justice of China has become independentfrom"the judicatory style of Ma Xiwu". However,underthesystemoftoday'Scircuitjustice,thestrongrandomnessofwayofcircuitjusticeisseriouslychallengingtheauthorityoflawandfairnessofprocedure.Afterall,astothewaysoftrialonpeople'Scourtunderthissystem,thatis,courtsonthebackofhorses,courtsinthefieldsandcourtsonthebedsofgrassrootpeople.aretheythecounterflowofnormalprocedure,oraviolationoftheauthorityoflaw?WithdecadesofthedevelopmentofChineseconstitutionality,ithasbeenkeepingappealingforthejusticeofprocedureatthetimeofsubstantivejustice?JudicialreforminChinatransplantsthemodemlegalsystemandideasofthewestemsocietybasedonthetraditionallocalresources.Ononehand,intheprocessofsocialdevelopmentandchanges,whenmodernizationoflegalsysteminChinaisacceleratingcontinuouslyjudicialreformisstillseekingatraditionaljudicialmodelandsystemwithpurelyChinesecharacteristics.Isthisaretrogressionofjudicature,oranexpedientmeasureinjudicialreform,oranupwardspiralprogressoflegalsystemabidingbythelawofnegationofnegationinthelawofdevelopment?Theappearanceofcircuitjusticeisanimpulsioninahotspot,apoliticalshow,orapracticalandeffectivemeasurefortheconvenienceofthepeopleunderthesituationintoday'SChina?Whywouldthisunusualphenomenonhappen?Ontheotherhand,wearepursuingamodernizedconstitutionality,exploringthemodernizedjudicialideasinwesternsociety.Forexample:whenreportsoncircuitjusticepublishedoverwhelminglythishot—spotjudicialphenomenonbecamethefocusoftheoristsandpractitioners.Theactualityofhotspotmaysublimatethroughresearchonelementarytheories,whiletheoryitselfcanbecomemoreactivatedandvitalizedduetotheintroductionofhotspot.Itisoutofthisideathattheauthorcarriesoutsomeresearchandinductionofaseriesofdocuments.Throughresearchandanalysis,theauthorcombinesjurisprudenceandsociologyinthispapertohaveafurtherstudyofthesubjectfromtheaspectsofpolitics,economics,cultureandjudicature...
