A Comparative Study On Legal System Of Seamen's Rights And Interests Protection

At present, the number of seamen in our country has reached over 150 million, ranking first in the world, and the protection of their rights and interests has attracted increasing attention. Due to the special working conditions, seamen need to be given special protection by law。The protection of seamen's rights and interests is less refered to in"Maritime Law". However, there are generalized provisions in"Regulation of the People's Republic of China on Seamen". To better protect the crew,"Seamen's Act"which is more comprehensive and ranks higher level, should be constituted.In the"Maritime Labour Convention2006", seamen's rights and interests mainly contain such key terms like minimum requirements for working on a ship, conditions of employment, accommodation, recreational facilities, medical care and social security protection. In this paper, summarizing the conservation status of seamen's rights and interests in our country ,comparing convention and other countries'legislation, the author make a deeper study on wage system, the repatriation system, relief system and supervision mechanism etc.. Meanwhile, combining"Ten Measures of Seamen's Development"set by Department of Transportations and shipping company's rules, tries to explore and perfect the legal system of the crew protection in many aspects.
