Because the seamen play important role on the shipping business, the international organizations and countries all of the word give a high value to the seamen legislations. The International Labor Organization passed Maritime Labor Convention in 2006 to give the seamen with decent work. Some countries drew up the seamen law, such as Germany, Japan, Korean etc., to protect the rights and interests of the seamen and the ships and the safety of shipping.China is the shipping big country, who owns 1,550,000 seamen, which ranks the world the first. But China have not drawn up the seamen law, the existing laws or regulations mostly on the seamen management, and the seamen labor protection legislations are very short and weak. The wages of the seamen are very lower, the rights guarantee is not perfect, which weaken the aggressive of the seamen to be engaged in shipping business. These problems do bad influences on the healthy development of shipping, which are disadvantageous to the national economy developments. Therefore, it is the most important problem to be resolved which is perfecting the seamen labor protections.Aiming at solving above problems, this dissertation tries to analyze and compare relative legal systems, administrative systems and rights guarantees in Korean with those in our country under methodologies of positivism, compare, and history analytical method. So that our problems and their roots could be unveiled, and then trying to put forward some legislative advices or amelioration adapting the satiation of our country and international tradition. I do really hope this dissertation could do some contributions to ensure the healthy, sequential developments of our seamen personnel placement markets and to further explore its potential development.
