With the increasingly upsurge of our country's housing price, there emerges a phenomynon of building and selling the houses on the collective owned land in various places which is so-called "minor-property-right house".The term discussed in this thesis refers to the houses built on the famers'collective owned land which is certified only by the seal of the township government and villiage party committee but not the House Ownership Certificate issued by the national real estate management. Though these houses have already appeared and become common, it's still illegal according to our modern land policy and real estate policy. It's beyond our law and policy, but it is centainly reasonable. Thus, the anaysis of the phenomynon of our country's "minor-property-right house"possessed kind of theoretical significance as well as strong realistic significance.The first part of the thesis gives a brief introduction of "minor-property-right house", including the definition and analysis of the current situation of it, the attitude and policy of the reletive governmental departments and the cognition and attitude of the common citizens towards it.The second part is the originality of the thesis. This part analyzes the phenomenon of "minor-property-right house" from different legal angels which include Constitution, Principle of Law, Civil Law, Criminal Law and Administrative Law, legal advantures of purchase and the legal problems reflected by the phenomenon.The third part is where the shoe pinches. It's the right moment to solve the problem aroused by the "minor-property-right house". However, it could not be accomplished in an action. This thesis tries to propose the solvement and strategies of the "minor-property-right house"systematically from both macroscopic and microcosmic views, especially the different treatment to different styles of "minor-property-right houses".
